I think that if you are drunk and you get in an accident and cause damage, injuries, fatalties; THEN and only then should you be charged. If you drive drunk and kill someone, I think you should be liable for death, if not life in prison.

The problem with our laws is that they treat us as if we are all little kids. Zero tolerance and strict guidelines tend to put those who only had 'a couple drinks' and are OK to drive into the category of being drunk. I think the idea of putting someone who is perfectly functional and passes all of the sobriety tests in JAIL because he had a .081 BAC is rediculous.

Also, when they tell you to touch your nose with the "tip" of your finger, make sure you use the pointy tip of your finger, and not the "pad" of your index finger. Yes, this will reult in the failure of a sobriety test. That is all the road pigs need to throw you in jail.

I think the OP thought that this was related to Miami in that it was a Miami ordinance, not the state's laws.

Do some research on MADD and its prohibitionist zelaots. (getmadd.com) Its ALL about money, nothing more, nothing less. part of the fines from your DUI are indeed 'mandatory donations' to madd. I think MADD also basicly bullied out the founder as she wasnt 0 tolerance enough for what they were hoping to achieve. Im very much an advocate of responsibile drinking and driving (not at the same time!), but I think madd has lost its place in the equation.

Death occurs in a non-alcoholic person typically at a BAC of 0.4.

Legal limit of alcohol is usually 0.08.

If they were really this hard on DUI offenders because they care about our safety, then why don't they punish you as hard for:
a) driving while tired
b) driving while over 80 years of age
c) driving while on mobile phone
d) driving while stupid

It is mostly about money. It is very similar to the war on drugs. We know the war on drugs is a failure, but too many companies profit from it now. So they will never let it be reformed. It's a gravy train.

The funniest example is prisons. Many of our prisons are now owned and operated by the private sector. They require more and more convicts in order to generate the revenue stream they desire.

Normal non-DUI traffic tickets are pretty obscene too. It is purely rent-seeking by the government on their assets (the roads). It's just a tax. As it turns out, it's politically easier to hire more cops to hand out tickets than it is to raise property tax.

If there was at that time an alcohol concentration in excess of 0.04 but less than 0.08 that fact may not give rise to any inference that the Defendant was or was not under the influence of alcohol, but the fact may be considered with other competent evidence in determining the guilt or innocence of the Defendant.

The lower the better, I don't want drunk drivers on the road... get a cab.... get a friend, but don't put me in danger because you are an idiot.

Obviously they charge you to make money, but not only are they making money, they are keeping the rest of the people safe. I don't care if the people's money was used to pay for the politicians prostitutes.. at least the drunk drivers are getting busted. I know too many people who have died because of this.
