not trying to break your spirits or give legal advice but i dont see much recourse here. They are going to argue that they are improving your living experience and construction is part of what happens to make improvements. I dont think you can argue that its a "slum" because things arent perfect though nor a correlation between the pool and your lease as being anything intentional. I doubt they have any requirement as too a time frame to fix the pool in accordance with your lease either.

Id say consult a lawyer and see what they say, but i just dont see much legal recourse for you that will be more cost effective than paying out the term of the lease. Court and lawyer costs will be more expensive most likely.

Default 18 Months of Construction - NO END IN SIGHT!!!

It has looked like this for 18 months, the pool has been torn up since October, with no sign of progress!http://img117.imageshack.us/img117/4723/1550bricke008ft8.7c94ceaad4.jpg (broken link)

One of the two elevators is almost always out of order. Very often, both elevators are out of order. Stairwells are always locked (elevator is the building's only means of escalation, probably for insurance reasons). Residents have "taped" the locks on the doors so they can access their rooms when the elevators break. http://img117.imageshack.us/img117/268/1550bricke012nt8.e7600cec27.jpg (broken link)http://img265.imageshack.us/img265/6779/1550bricke015co2.d270043a04.jpg (broken link)2 of 4 pieces of gym equipment are broken - and have been for a year.http://img119.imageshack.us/img119/4673/1550bricke018ll9.98cf7650cd.jpg (broken link)

If I had known my pool would have been shut down nearly the entire duration of my lease extention, 12 months, I would not have renewed my lease. Also, the gym equipment in our tiny exercise room has deteriorated since I moved in, with about half of it not working. I was wondering if there is anyone on here that can help me identify some kind of recourse to retrieve monies LOST. I pay $1800 a month for an apartment that is worth $1300, at best, and with no amenities.
Hey Marlin Darlin', Do you know if this property is still in renovation? Is it still as bad as you describe it or did it get any better? I might move in therefore I'm asking?

Thank you and kind regards,

This place, 1550 Brickell, has been fixed up quite nicely. The pool and gym have been operational for quite some time. Parking is behind the gate which requires a transponder for tenants. Although guest parking is not too abundant, I ever had any problems parking there. I have a friend who just moved out to a cheaper place close by but not on Brickell.
