
We just received a knock at the door from a county clerk approx at 9:30 pm serving a summons for a Capital unpaid Credit Card debt belonging to my mother. The summons was singed for by my 17 year old daughter. Not sure if this is legal to begin with as she is a minor. Is is dated and signed by the court on 1/26/09, but we did not get it unitl today.
However, my mother does not dispute the debt. The credit card had a $3,000.00 credit limit. She stopped paying over 2 years ago as my dad was very ill and they were living solely off her income and a measly $300 SSI check he received. My father passed away 1 year ago and I had to I relocated from GA to Miami and move in with my mother to her home (not owned by her, but under owned by my sister) to ensure the mortgage and other bills were paid. She never payed for any other credit card after my father passed away as we incurred alot of expenses after his death. Point being She makes $1200.00 a month and pays approx 75% of that in bills. The rest is used in cost of living for herself and for other misc costs. She had received letter from creditors but ignored them. She has no assets under her name. Now this $3,000.00 credit card has become a $5,500.00 plus $950.00 attorneys fee debt. I need help in responding to this court summons. Please help....
