ursula...it seems Cuba Libre did not take the time to actually read your post, so don't pay attention to him. Just keep your bank statements..put everything in a file and when you come to Miami you can take them to small claims court to get any monies owed to you. Good luck.

Small claims?

No wonder there are so many skeezy bus stop advertising lawyers on the prowl in Miami, because people can't settle little bitty disputes. Maybe this is because Miami was founded by greedy lawyers from New York, maybe it is because nobody speaks the same language. I don't know.

Dear Ursula
I wish you luck. You should not have to hire an attorney. Put everything in writing and direct your letter to the board of directors to show that you have paid on time. Send this letter by registered mail to prove that they have received it. The addresses are available from the property managers office.

Do not give the letter to the property manager. You have a legal right to have the mailing addresses of the members of your board of directors. If you can only get their phone numbers then call them and ask for their mailing address so that you can mail them your information.

By mailing the information you have established that you made contact. Telephoning is not accepted as proof.

After you have cleared this matter up you should get involved. The property manager is hired by the board of directors and works FOR the owners. The property manager is not the boss, the board of directors can get another manager if enough owners think they are not doing a good job.

I will never live/own another condo or home in an Homeowners Association. Yes our property manager was bad also. They want to collect late fees and keep the money This happened at one condo. At another condo the manager told different stories to different people, getting people mad at each other so he could be in control of everything. He's gone now.

We thank all of you for your replies.From September 09 until today's date,November 2/2009 there is no reply or substantive response or correction of our association account by Moderator cut: Names Not Allowed our property manager of The Continental Group in Hollywood to whom we have sent all our contradictions and inquiries(via mail,emails,faxes) since March 2009.This month our account is charged with $ 357 late fees although we have proofed this property manager since March via our Bank of America Bill Payment statements with the deliver dates and remarks: processed on them, that we paid our maintenance fees on time.The Property Manager is ignoring these facts and didn't waive the late fees.The Board of Director to whom we have sent the mail and copies of statements in June promised to solve this problem with the property manager,sold his house and moved away.As we are not going to accept this fraud will this matter be a case for the State Attorney?

You should continue to reach the president and other directors of your board of directors with your proof. Send by registered mail.

I found the following information online to make a formal comlaint about your property manager. If they are a CAM (community association manager) they may be licensed or unlicensed. The licensed CAM's have a higher standard for their actions.

You may have asked Bank of America send a check on the 1st of the month but the Association is not receiving it on the 1st. Depending on where the check is mailed from would determine how long it takes to get to the Association.
B of A is not sending checks from a local branch. They could be doing their mailings from across the country. I know Citibank asks that you send checks at least 5 or 6 days ahead of when they are due.
You need to find out when late fees are assessed i.e. are fees considered "late" if they arrive after the 1st? If that is the case you need to have the bank send the check earlier to give it plenty of time to get there.
