By and large, Target Field was financed with taxpayer dollars. I'm not sure if the same rules that normally apply to a wholly-private operation fully apply in the case of TF. This is not a decency issue, as implied by southernsmoke, as no evidence of such was presented, but a discrimination issue.

I intend for this to (hopefully) be my last post on this subject in this thread (because we have already had a lengthy and similar discussion on this forum).

There is a huge difference between saying "no blacks allowed in my [venue/store/restaurant/etc.]" and saying "you will be kicked out of my [venue] if you engage in [behavior X]." Any reasonable legal system (that values the rights of property owners at all) will recognize this--and Minnesota's may, but the statute is arguably ambiguous.

This gets at the logical dissonance behind the argument that "people who choose to engage in homosexual behavior" should be a protected class. I don't have a big problem with the law generally requiring you to serve everybody in your establishment if they follow your rules as the proprietor. But I do have a problem with the law telling you that you can't set a code of conduct in your establishment. This is where sexual preference differs from other protected categories.

I don't really think the argument is whether or not they can kiss though.

I think many would agree with you that a business owner should be allowed to set a code of conduct.

The issue at hand would be that the couple were engaging in PDA, not that they were gay, though obviously they were likely singled out because two men or two women engaging in PDA is usually more noticeable (only because it is less common) than heterosexual PDA. But gay or straight, the rules should be followed. Nobody should be able to kick you out or disrupt you simply because you're homosexual though (assuming you aren't breaking any code such as PDA).

That said, the state of Minnesota owns the ballpark, not the Twins, so this is not some business being squashed by the big, bad government regulating acceptance.

Don't bother with Southernsmoke. He's a political agitator, probably working out of the basement of some right wing think tank in Reston, Virginia. If you've got a question about a decent restaurant or bike trail in the metro area, he's mum - he doesn't know squat. But if you want to know his opinions about union busting, funneling tax dollars to his bosses, or disrespecting minorities - even if you don't want to know - he's there for you.
