Intent.
What was his intent when he got up and went over to confront him and subsequently punching him?

humm, when the guy stood up why didn't the cop back up?
intent.
Instead he clenched his fist and punched the guy.
His intent was to hurt him and he did.
He is is responsible for his injuries and putting him into a coma and he should be held responsible for it.


Even if the guy was inebriated the cop didn't need to throw a punch in stead his inner Rambo came to the surface and we all see the results.

The cop made the situation worse that it need to be.
The off duty cop should have called an on duty cop to handle the situation or he should have left the area himself.

Sure, he could have asked him to settle down as he was only a few feet away. He didn't need to go poke the guy and stand over him acting all authoritative and superior. He could have taken his business elsewhere
or like mentioned had the establishment take care of it.

Apparently Sgt Roid-head was the only one of all the dozens of people on the patio that felt bothered enough to even approach the assault victim prior to the assault. Employees at Tanner's Station told police they didn't overhear any offensive language from Brian Vander Lee, and Sgt. Clifford admitted he could have gone to an employee instead of making a scene.

lets also not forget that after Officer Scowley "" fled across the street, his wifey picks him up and that is how they got his license plate which was registered to both him and Mrs. Boot-Jack. Law enforcement then go to their house but the lights weren't on and nobody would answer the door or phone. Next day after he sobers/lawyers-up, he makes himself available for questioning.

part of his release bond stipulates that he refrain from alcohol use

same cop was also involved with a previous excessive force lawsuit that cost the city $55,000.

Intent only takes you so far - the eggshell victim is the person who you didn't know had a bad heart, but when you scare them they have a heart attack - your bad luck - they are dead just the same. The press will abandon this story long before it is all said and done, but he's in for a long haul and deservedly so.

I would hope the wife is charged for aiding & abetting a felony or something to that effect as the get-away driver & perhaps as an accessory after-the-fact or obstructing justice for helping to hide the perpetrator.

I'm going to learn from Sargent Testosterone. If someone is over consuming and belligerent, I'm going to talk with management and let them deal with it versus asking to quiet down. If you try to stop it yourself, you might be entering a situation that will ramp up.

In fairness, that's not just an opinion that I'm pulling out of my backside-- MPD has been cited in research studies as one of the most likely to profile based on race, and we all know the drama involving Dolan, the gang task force, et al.

i read the article your OP is not what it implies at all. it appears there was an altercation and that the alleged victim was about to punch the officer who was off duty. this looks alot like another cop hate thread.

Looks like it's Amy Senser all over again....hide to avoid an alcohol related charge?

Realize that the video says that the altercation started 5 minutes after the Cop takes a seat at the table. So he would have had to be drunk before he arrived.

I live in Andover and I've sat on that outdoor deck many times. Service is slow and the Happy Hour drinks are weak. So he certainly was not overserved at THAT Happy Hour. I'm sure he tried to get away unnoticed but he later learned the cameras captured his plates. It mentioned in that video that police were knocking at his door even with his homes lights on. It is also a fact that people in Andover are fiscally conservative. So no one leaves a lot of lights on without being home (we are all cheap in Andover). I bet he was peering out the window like Gladys Kravitz of Bewitched. That's when he decided to "Lawyered up".
