My coworker, Matt, was late to work due to getting pulled over. He has a motorcycle permit and was riding his bike to work. He wasn't wearing a helmet and had a hoddie up cuz it was 6 am. He pulled into a local grocery store parking lot to pick up breakfast and the cop followed him in, no lights or siren going. The officer got out and gave him a ticket for no helmet. He was in the parking lot when this occured. Dose he have a chance to fight this in court? The officer couldn't tell if he had a helmet on due to is hoddie. Was this traffic stop legal?

Sorry, but I'm pretty sure a hoodie wouldn't prevent somebody from being able to tell if he had a helmet on. Pay the fine and wear a helmet next time.

How old is he? There is no helmet law for people over 18 in MN.

I noticed that he said motorcycle permit, not motorcycle license. I believe people with just a motorcycle permit have to wear a helmet, even if over 18. They also can't ride at night, ride on the interstate, or carry passengers.

He is 19, and only has a permit, not a license. Is the fact that the cop followed him for several blocks and gave him ticket after he parked in a grocery store parking lot with no lights or siern going proper procedure?

Yes. They don't have to turn on their lights to pull you over--they do that to get you to stop. Since he stopped in the parking lot, not necessary. If he was supposed to wear a helmet and wasn't, why is he trying to get out of the ticket, he was wrong, end of story.

He may perhaps have broken some sort of local ordinance, but we can't verify because you didn't say where this took place.

I believe it's comon to have Helmet wearing part of having the Permit. Once you are past the check ride you have the choice. Before then the law is the law. Wear a helmet until you get your license.

The officer in this case is well within his rights.

Is there a way to tell if you are riding with a permit instead of a license. Is this something that can be determined from the license plate? If not then I'm surprised the cop questioned your friend about it, I mean how did the cop know he didn't have a license? Shouldn't he have some other kind of probable cause before he starts interrogating him?
