my friend is currently working temporarily in montana and heard that MT has NO sales taxes on purchases. Some of his out-of-state co-workers want to buy motorcycles, cars and big ticket items while they are in MT. Can a person with temporary residence qualify for this no sales tax treatment? Would anybody verify their addresses when buying an auto or motorcycle?

Yes, they should verify it. It is my understanding the only way you can get away with what you are trying to do (which is fraud) is by setting up a LLC or some other type corporation here which is what people who buy big ticket motorhomes do. Other states are wise to people coming here to buy vehicles and are pretty good at catching them. The other states would find it very strange that one person up here is suddenly buying vehicles and then selling them to out of state others, and this is found out when you try to license them in another state so soon after purchase.

jim,

these folks are not trying to resell anything! they want to buy these vehicles for their own personal pleasure. but i disagree with you that other states would really give a hoot about out-of-state license plates on these cars. i drove with texas plates in calif and calif plates in texas and was never stopped except when i was caught speeding. many states (incl tex) now impose a fee to register an out-of-state vehicle, an unfair tax in my opinion. i think that most taxes on cars are in fact immoral. i'm just wondering if they list the house where they're staying at as place of residence if that would work. after all, who's to say that a "temporary" job may unknowingly turn into a "permanent" one?

There was just a big article in the paper here a couple of months ago about this very thing. I was not suggesting that they were reselling them. When you register a vehicle here you have to have proof of residency. So either all of those people would have to have a way to prove it or would have to get this one person to buy the vehicles and then transfer them to the others which would trigger someone wondering why these are transfered with no cash.
I don't like the tax either as I have lived elsewhere and had to pay it. Trust me, if it was possible to do without the corp dodge don't you think the wealthy would have done it with their mega motorhomes? We are taxed here out the wazzzoo and this sales tax is the only thing we don't pay, one of the minor benefits of living here..... And as I said before, it is tax fraud and if you do get caught is it worth it?
