I have to appear at the Broadwater County district court to have a charge dismissed (failure to carry proof of insurance; apparently I forgot to put it in my car ). Just wondering if anyone knows what this is like - namely, how long the process takes. Once dealt with the traffic court process in New York and I had a nice long 4 hour wait there just to get to my case. Wondering if this will be more of the same

I had to deal with the same situation in Toole County - had a hit a deer and was waiting for the tow truck when State Trooper arrives... He asks why I didn't call 911. I tell him I didn't hurt anything and deer was off the road - only thing that needed any attention was my car and I had that taken care of. Trooper informs me he's going to cite me for failing to call in an accident and walks back to his car after all I can find in my glove box is an insurance proof that is 6 months old ( must have thrown out the new one instead of the old). He comes back and says he's giving me a warning on the reporting accident thing but IS going to cite me on no proof of current insurance but if I brought proof in within 30 days or something like that it would be dismissed.

It was very painless - I got a new copy of my insurance and took it to the courthouse and walked right into the office where the secretary promptly took a quick look, stamped it as dismissed, and filed a copy away. Whole process took an easy 10 minutes....

Under MT law, if you show the court that you had coverage, but just ot the certificate, they will dismiss the charge. Also, I seriously doubt that you'll have much of a wait in Broadwater County (Townsend?); it is a very small county. More like 10 minutes, probably.

Some insurance companies are tied into the CA state system so your proof of insurance is always on your record. State Farm is that way, so if I can't find the cert. it's not a big deal. No real reason why MT couldn't do the same thing, at least with the major carriers.

Heck Montana doesn't even make you show proof of insurance when you register a vehicle or when getting a drivers license.

Wyoming has you simply sign the back of the form under a statement that says, "I hereby state that I have valid Insurance."

One thing that they went to down here and I would imagine it's going to be that way in every state soon. If your insurance expires and you do not renew it, the insurance reports via computer, to DMV that it expired and DMV put's "Registration invalid" in the computer. If a hp or local calls in your tags, it comes up on the screen that your registration is invalid.

Yup, exact same thing happened to me, except I was pulled over and given a warning for going 7mph over the speed limit. Good to hear the process is painless anyway; if I were still living in New York it'd be a all-day-long grind for sure.

I live directly next door to our town's police department and my rear plate is always so covered with mud you can't read it anyway.
I never get pulled over and see very few state patrol cars anyway. I enjoy having a squeaky clean record almost as much as having no credit card debt !
Is night court as funny as folks say ? I don't even know if they have that here but if I did get a ticket and wanted to contest it I sure wouldn't want to miss a day of work to go to court. Good thing I don't have a boss, -- oops I guess I do. That would be my wife !

I had to do the same thing in Gallatin, for my wife and all I had to do was go to the L&J and show the gal at the counter my current insurance card. All she did was pull the ticket out of the file cabinet, took a photocopy of our insurance card, stamped the ticket and all was said and done. Didn't even have to appear in court.
