Do we have to have spouse in title and title insurance if we need to have spouse in deed of trust? How does this work in Texas?


My spouse is not in Title Comittment letter received from title insurance company. But the lender says my spouse needs to be in the title as well as deed of trust.



Title company says spouse needs to be added to the original agreement of sale(new construction) to get spouse added to the Title



Please shed some lights. I am 3 days away from closing

On a primary residence in TX married partners must both be on title. However, this is a easy fix. The title company will add your spouse's name to the title policy and the builder will make an addendum adding your spouse as buyer. This should not hold up your closing.

Agree. Should be an easy fix. Call the seller's agent this morning. Take your spouse with you to do the amendment. Once it's also signed by the seller you can fax or email the completed document to the title company rep with whom you should already be acquainted.

This is helpful. That's what the title/escrow agent told. I am working to add my spouse to the contract using "Name Change Endorsement".



Follow up clarification here. My lender will issue the Closing Disclosure this Monday(26th) for Thursday(29th) closing. Lender would not wait for this to happen to send closing disclosure, correct?

Depends on the lender. Some lenders won't issue the CD until they have a clear to close, which you can't get until the title situation is resolved and the underwriter reviews. Other lenders will issue the CD as long as they have appraisal, title and insurance.

Call your loan officer and ask tomorrow morning.

Thank you all for the information...! This is sorted out. Builder approved the Name change endorsement and Title Insurance company added my spouse's name in 2 days. So I had it ready by Monday 26th afternoon.
