I think I figured it out. The film was Fallen with Denzel Washington. Fallen and The Jackal came out in 1998 and 1997, and I rented both with the same group of friends, probably around the same time, but the title of The Jackal just stuck in my mind more.

For some reason, I keep thinking that Rutger Hauer survived in the original version of "The Hitcher," but I may be wrong.

The little old ladies in "Arsenic and Old Lace" got away with killing quite a few folks, but weren't severely punished for it.

Horror movies seem to have the "bad guy" just carrying on: (1) The Car - They never could destroy it, and in the last shot of the movie, it was seen driving towards a big city; (2) The little boy in the first Omen movie survived; (3) The creature in Jeepers Creepers keeps coming back every 25 years; (4) Gena Rowland was able to transfer into someone else's body in The Skeleton Key; (5) One girl escaped in The Cave, even though she was infected.

In my original post, I asked about movies where the bad guy got away and the good guy died attempting to stop the bad guy. Of course, the characters in question don't have to be "guys"!
