dafunk10, what is the shared space? How is it shared? What do you mean by shared? How did this work out till now?

Was it legally determined that the space is shared and so somegow you all have a common interest?

The essential thing is what name is on the county record as owner of the shared area?

the shared space is the alley behind the properties...used by all to access the garages and has been legally determined as shared space

the name on the county record is that of what the development's HOA would have been called (I assume)....it actually has "homeowner's association" in its name


From what I gather, the reason this didn't get started initially is that the developer had to have 50% of the units sold before the bank would continue lending, so the HOA didn't get formed right away (and then they just never got around to it)

So did they default? Was it sold to another developer?

There are a lot of rules, and it could take a year to form an HOA.

Find out what's already set up, then check the regulations in your city.

I'm familiar with those alleys particularly in older areas. Well...also newer areas too that want to recapture the walking on sidewalks and parking in the rear idea.

You should then have some documents from the developer. If you still don't get a majority this time perhaps it's not such a big deal. If everyone has to fix up their homes, everyone should as best as possible. And perhaps others can chip in physically and even with some funds to help those who can't afford it. (a la the idea of what one would pay in a few months of hoa funds and also one of the Christmas in April or various efforts to help out others fix up their homes. One often doesn't have to go further than down the block to find a good cause.)

I think in order to form a "association or community board, it would require a 2/3 majority and then they cannot require you to join or to charge you association dues.
