I was recently disqualified for unemployment based on the employer's claim I was fired for misconduct. I was told by my Supervisor the reason for my termination was personal use of a company vehicle however the reason they gave to the Dept of Labor was attendance. During the adjudication process I asked if they would have to show I was warned regarding attendance because I knew I hadn't been warned. The adjudicator told me they would and when I was notified of my disqualification I was told the employer had presented documentation of me being warned that included my signature. I requested copies of my employee files and there is a warning included but it does not include my signature. Is a warning that shows no evidence the employee was notified sufficient for denial? What are my chances at appeal? There is nothing that proves I was warned. Does an employer have to show proof of an attendance issue such as time clock records?
