eligible for Unemployment in NE due to hardship ?
I really need some help and guidance please Here is the deal:
1) husband couldnt' find job in ny, so found a good job that he likes in NE.
2) husband pays out of pocket to come home every 5 weeks or so for a few days
3) husband had to pay out of pocket to rent & furnish apt and pay utilities and 2nd household expenses, while paying mortgage, etc on home in NY
4) We tried to sell our home for over 15 months with no luck
5) Family stress level is at an all time high with this living situation
6) for financial and family and sanity reasons husband wants to quit job, and come home to be able to dedicate 100% time to look for local job
here are my questions:
1) if a person is eligible for UEI if htey quit to follow a spouse to a new job, is the same true here...family has been left behind
2) are the above reasons "compelling", "good cause" and all the other jargon that goes with UEI
3) I am assuming he will file in NE?
4) if the employer fights the claim, will husband have to appeal it in person in NE (the employer likes him, and he likes them and he does a good job)..
5) is there a apeacial way he should word the resignation letter to assist with the claim in any way
6) I read that NE does have a clause for "good cause" in their insurance..what do you think the chances are?
7) he is giving 3 weeks notice....when should he can he file?
Thanks for any infor you can give....at this point, the unemployment is secondary to him coming home.

Most people will tell you that if you quit a job you will not get Unemployment, but in Nebraska that is not always the case! I know from experience that if you do a no call/ no show to purposely get fired and then when you file for unemployment (in Nebraska) and even if the employer says you quit, they will still give you the unemployment, but he will get a 12 week disqualification which just means they will deduct 12 weeks worth of payments from the claim; however, because of the EUA of 2008 he will be able to get a 13 week extension, thus getting the 12 weeks back! And technically, if you are fired for no call / no show, you were still fired, so its not even lying, just a technicality. He may not want to list this job on his resume after that though, just list the whole time as unemployed/looking for work. Hope this info helps!

so in nebraska; you can get UEI for a no call no show..that would never fly in NY...and my husband would never do that either, one it is n't in his nature and 2 this job is fairly prestigious and could help him garner another job, thanks for the response though....and i had forgotten about the extension....

Well I don't know if its supposed to be that way, but in my experience that is how it worked out.

My experience has been the opposite. My wife voluntarilly quit her job, despite documented unethical/illegal behavior which is too complicated to go into here, but she was denied because it was a voluntary quit. She is in the process of appealing.
They said that any voluntary quit is a quit, and don't seem to take extenuating circumstances into consideration anymore. It also took them 10 weeks to give her that determination, as they are currently so backlogged on claims.
