On the other hand, simple "Car Theft" does not involve the forced taking of a vehicle from the owner. There is no use of force or fear used against the person in control of the vehicle. It is a property crime, but it is also included as a Part 1 crime.

As for the statement about a "justifiable shoot," I hope nobody believes that statement in such a broad manner. It's not always true.

I don't want to get into an entire discussion about it since it would be off-topic and probably end up in a highly charged or severly opinionated discussion. Let me just say that the issue needs to be entered into in an educated manner, justified by the reasonable state of mind of the victim, the circumstances of each event and the varying laws in each state. Any broadly applied recommendation, like the one that was made, can be very harmful if someone takes it to heart without thinking.
And, you obtained your CCW, when? LVMPD considers carjacking as any vehicle related theft--sorry: Las Vegas Metropolitan Police Department And, by the way; if you fear your life, or that of another, shooting, is a justifiable action. Things like property crime, are not.

The HUGE difference is----was the structure--vehicle OCCUPIED. This is the difference between fearing for one's life; or not. ANY threat to your life, or another's, is absolutely considered a justifiable shoot.

Sheriff, stop stirring the pot. I'll play in the mud with you for the moment, but I hate doing it for very long.

What you wrote in additional posts adds to the scenario but wasn't stated in your broad initial statement. You can't justify shooting someone else just on a broad statement like you did. It can result in a bad decision. You need more than you first wrote, and you know that if you've had any responsible training.

For example, you can have a "carjacking" by the use of force but without the fear of death, or another factor that justifies a use of deadly force (see below). That doesn't qualify as good shooting scenario.

Justification can also differ from one to person to the next. It's the state of mind, life experiences, and abilities of the victim that enter the equation to show that their fear was reasonable.

In other words, it's not as simple as justifying an action by the crime alone as you initially wrote. It's one just part of the equation.

Further, to answer your baiting question, my CCW is a national CCW. It was not granted from a local training class at a gun shop, which is only good only in the state of training and any states that have agreements to honor it. I will only explain that I had decades of shoot v no-shoot situations in real-life urban situations. . . which resulted in both decisions over the years.

One last thing . . . what justifies a reasonable use of deadly force is not just a threat to one's life or the life of another. A person can also be in fear of "great bodily injury." It doesn't have to be death, at least in the state I am from. Of course, check out the laws in yoru own state.

There are some states that will differ in the justifications for the use of deadly force, to some degree, or have a preference to escape a situation if it's available. In fact, one's willingness to show a desire to avoid a situation will go far towards justifying the ultimate use of deadly force when it's eventually needed to protect one from death or great bodily injury.

Now that this thread has deteriated, I hope this entire issues dies a timely death.

Right, me too. You should know then, that fear for one's life, or that of another is a "good" shoot.

Thanks, I'm glad we agree and that it appears you agree someone needs more than just citing a crime to justify a serious action. Take care.
