I was reading through NH taxes today (work related not for personal enjoyment) and I noticed that the meals tax does not apply to meals costing less than 0.36.

Why can't a business sell all of their meals for 0.35 and simply add a "gratuity" of the meals cost. Wouldn't that technically bypass the meals tax?

Maybe a restaurateur or accountant can answer this one?

I suppose you could buy a piece of cheese for 35 cents.....LOL


the gratuity would have to go to the waiter/waitress and not the employer....so the owner of the restaurant would not make any $$ at all.

That's traditionally what a gratuity is for, wait staff, but that could be easily changed with some employment agreement or simply being waited on by the proprietors. I think a "gratuity" can essentially be anything to anyone at anytime. Then, I'm not a lawyer or a businessman.

gratuity is taxed at 10%, higher than the meals tax of 8%..
