I rent out the upstairs apartment in a 2 unit home in collingswood NJ and in my lease it states that I am only allowed street parking in the front of the house however the couple that lives downstairs are allowed the driveway. But when they throw parties or have get togethers they often let their friends park in front of the house and in my "spot" per say to that I have to sometimes travel far distances to get back and forth to my front door. Specifically, my lease says this about parking
"When and if RESIDENT is assigned parking area/space on OWNER'S property, the parking area/space shall be used exclusively for parking of passenger automobiles and/or those approved vehicles listed on RESIDENT'S application attached hereto. RESIDENT is hereby assigned parking or permitted to park only in the following area or space __"FRONT OF HOUSE"__. The parking fee for this space is $0. Said space shall not be used for washing, repairing, etc of vehicle. No other parking space shall be used for residents or residents' guests. Resident is responsible for all oil leaks and blah, blah, blah."
So, what do you guys think?? Can I fight with my downstairs neighbors about parking to my landlord or no??
So I guess there's not much I can do then, since it's street parking I'm allowed only and not the use of the driveway?
You could talk to your neighbors about it, but frankly even there you don't have much of a complaint. Let's say they prevent their guests from parking in "your spot," anyone else from the neighborhood or their guests can park in "your spot" too, so why bother. But yeah, from a legal perspective, so long as street parking doesn't require a permit in your area, then everyone has the same legal rights to park on the street as everyone else.
If it is a public street then there is nothing you can do. The landlord has no authority to assign you a space on a public road. However, is there room in the driveway for 2 cars? Perhaps you can ask the landlord to amend your lease and let you park in the driveway. If there is no room then, I'm sorry. You will just have to walk. Another idea is to ask your neighbors help you. Go over with some cookies or bottle of wine and talk with them. Maybe they could ask their visitors to park farther down.
