bank accepted our counter offer........now over weekend we decided we don't want house........did not sign contract yet can we back out of deal.......

If you didn't sign anything there is nothing to back out of. How did you make the offer? Was it verbal?

Default we faxed over an offer they accepted but we didn't sign contracts....

faxed over offer through agent bank accepted but we didn't sign anything

Was this a short sale or foreclosure purchase? You can pull out of the deal for any reason during the 3 day attorney review period. Weird your agent wrote up an offer and faxed it over without you signing it.....

of course you can, anything before attorney review are finalized is meaningless. If you paid some deposite money might lose that, otherwise just walk away.

As long as you didn't initial or sign the final draft of the contract and you're not out of attorney review you should be able to walk away no problem as there is no legal and binding contract.

I'm surprised the agent didn't make you sign a contract - was it the seller's agent you were working with or did you have a Buyers Agent representing you?
