Dad passed away.......His employer and the life insurance co didn't have a form on file for him stating his beneficiary......years ago he gave me a copy of the form......just found it......let life insurance company know about it .....i sent it to them clearly listing me as the beneifciary ......insurance company can't honor it because it didn't come from his former employer........wondering about this?.....

That's crap - It's EASIER for the insurance company to award the money to a person vs. their estate. Try speaking to a supervisor at the insurance company.

Who is listed as the beneficiary, according to the insurance company's records? What's their take on the form you have but no one else does?

I would suggest that you verify the policy still exists and is valid. If it was whole life it paid a dividend and would be on his 2010 IRS tax return. If it was term look at his paid bills, checks, auto deductions, etc.

If it was valid and the beneficiary is blank and you are the sole heir the payout I believe would go to you. If it's "currently" blank and there are multiple heirs I think it will have to be shared.

In estates most things are considered in term of "time of death" and the document you have may have changed, not been properly updated, etc.

Just do your homework and file the proper estate/surrogate documents.

Go through the insurance papers again thoroughly if it as really got proper documentation so get a bit of advice from legal adviser and proceed accordingly. You may contact any reputed insurance adviser to for the second opinion.

At this point, I would get a lawyer. Don't mess around going back and forth with the insurance company. You may end up saying, or worse, writing something that will screw up your claim. Just hire a lawyer if you don’t already have one dealing with your father’s estate.
