Well I told the realtor.."reasonable" - I also told him I recently rejected an offer and told him what that offer was so hopefully he'll get the message ; )

It sounds like you don't actually have the offer yet. So if they are waiting to see if you will even consider it, I would tell them yes. Let them present it to you, and see what's good & what's not. I mean, are you inundated with offers to the point that you can toss away a good one? If you can agree to the other terms (and as a rule I would expect to demand at least slightly higher a price for your consideration of the contingency) then you can work out a contingency plan. I would suggest that you put in deadlines for certain key points, such as when their house gets listed. Make sure you retain the right to market the property until they have either satisfied or removed the home sale contingency. Give them the right to remove the contingency within 24 hours of you receiving any other bona fide offer. It's all about risk, right? In order for this transaction t happen, another one has to happen. Who gets hurt if the other one doesn't happen? You want to minimize your potential to get hurt. They will be trying to do the same thing, so make sure you are careful about what you accept.

No you don't have to take off the market, You can still show it and see if you get another offer. Rememer its your house until you close.
you can count with anything you want. Like this counter with 30 or 60 day Contingency clause and you want to continue to show while you wait.

Wileynj .............. don't tell them your terms until you get a signed written contracted in your hands women. (Its like poker) ..... then take that contract to your lawyer to look over.

How's he supposed to negotiate, to get to a signed written contract, if he won't disclose what terms he wants?

Thanks for all the good advice - I have a feeling soemthing written is going to come through today. I have a very savvy attorney...who is also a good friend. I'm sure she will do everything in her power to make sure I'm protected. The other positive... I have others who are interested but just sitting back - waiting to see what comes on the market in the spring or to see how low prices will drop... perhaps a phone call the their realtors might be in order ; ) Do I smell bidding war..lol - would be a miracle in this market!
