We are buying a property in which single car garage was converted into a living space many years ago.The converted space shows up as a living space in the tax record and is included in the total sqft of the home however the OPRA report doesn't have any permits for the conversion.We plan to convert the room back to garage in future.However since the tax record shows the room ..the sellers refused to obtain any permits for the same.Even the town doesnt have any record of the same (we verified by personally visiting the town).The tax dept said that the homes in the area have been evaluated many times in last 20 years.The attorney said the same thing as well that if it shows up in the tax record,we should be fine. Anyone with a similar experience?

I'm not an attorney, but this could be a problem with taxes or getting a CO.

With the sellers refusing to get permits I'd be very careful, even with what your attorney is saying.

Thanks for replying.

So, as far as the tax and CO is concerned..we did pulled it from the town and the tax record shows the converted living space in the map.

Moreover, the house has been passed though 3-4 hands in last 10 years and been evaluated by the town too.Thats the explaination seller is giving.

I wouldn't worry about it as long as it is in your contract that the sellers have to get the CO

Once you rip it out, then try to get your square footage and taxes lowered. There's no need for the sellers to go get permits if you are going to rip it out. And they probably won't be able to get them anyway

The other option is to try to get them to rip out the room (not that hard). You'll still have to try to fix the taxes

Or to walk away

I don't think it is reasonable to expect the seller to provide permits for something done 4 owners ago that the town already knows about. If you plan on ripping it out anyway, I am not clear why you even care about the permits. You are going to have to go get your own permits to remove the living space.
