Hi,

Does anyone know how does a divorce affect a kid's status in attending public school?

Say before the divorce, the family lived in School District A, but after the divorce, father moves to District B, mother still lives in District A, kid spent approximately equal time with both parents, but may be a few days more with father. Can the kid still legally attend school in District A for free?

Based on the description you give above I wouldn't see why the student wouldn't remain/stlll legally attend school in district A.

BUT there is NO REASON TO MENTION this to your current school or district. Further, the most important red flag in situations like this is if the home address is changing - but it is NOT - your child will still live there, just not every day of the month. Don't create more hassle for yourself by bringing it up. Leave it alone.

Thank you. But I want to make sure it is legal rather than for the District to ask me for tuition at a later time. I thought this type of living arrangement must have happened in some families.

NJ Parents - Law and Policy

"parent whose permanent home is located within the district"

You should be ok.
