i am renting a home and have 6 months left on the lease but come to find out the home is making my son sick (coughing alot but is fine when we go out ). i want to do the right thing but my sons health is more important. any thoughts on how i can get out of the lease?

Without spending some $$ to prove that it's actually the house that's causing the sickness, I'd say you don't have a leg to stand on.

You could call your landlord and tell him you need to move and would like to end the lease...see what he tells you.

I had tenents do that to me. They signed for a year and found a house they wanted to buy (actually put an offer in and had a closing date by the time I was notified) about 4 months in. She also worked for an attorney so she had all her ducks in a row, trust me. She offered to pay for advertising until we found new tenants and the rent until new tenants moved in.

Unless you are willing to do that or you can find out exactly what your son is allergic to and prove it is in the house, you'll be sued if you break the lease and run.

I always find it best to try to resolve issues person to person before having to take further steps.

Re-read your lease. Some have early termination clauses where they allow for it but you have to pay fees. But generally, you have to keep paying even if you move out until they can find another tenant. I took it upon myself to have a cleaning crew come in to shampoo the rugs and make the place immaculate, fix any nail holes minor damage, etc just so there were no 'issues'. I paid for advertising and had to show the place to 2-3 potentials before I moved out. I ended up only having to pay one extra month (after I moved out) because they found someone else to take the place.

The other option is to pay for someone to do an air quality test and test for mold. Depending on the results you can then have the landlord fix the problems. But you'll have to stay put until its all resolved.

thanks everyone for your help.we know what ever road we take its going to cost us money. we have been asking around if someone is looking for a rental.alot of folk tells us to just leave but thats not the right to do.

Take your son to a doctor too. While the doc probably won't give you a note without a whole bunch of tests being done on both your son and the apartment, it might help the situation if your landlord knows the doctor thinks it might have something to do with the apartment too.
