You're getting conflicting information here. Each one seems to know what they are talking about. You did say your Husband is a truck driver working for a company in NJ. Some people do not understand that a truck driver just does not drive in NJ, but drives all over. If you get unemployment from where the company is located as one post mentioned, then it seems you file in NJ. If you get unemployment from where you reside, then you file in WV as another post mentioned........LOL

IF they took NJ unemployment out of his check, should he not get the NJ unemployment?

If they took WV unemployment out of his check then he should get WV unemployment.

Of course this is NJ so they probably took NJ unemployment out of his check but wont allow him to file at all. THAT would be the NJ way. Tax early and often.

Question: Comission Sales and Unemployment. Just went on unemployment. Have job offers as commision salesman. How does that affect your unemployment benefit? For the week you received the check or when you make the sale? Is there a dollor amount limit to the commission sale, ie: if the commision check is 100k do you lose your benefit for ever? etc.etc. I tried to call unemployment commission but can't get thru..too busy.

Iv'e bin employed as a realitor by a new home builder for 5 years. Im paid salary plus commision which are both paid in regluar weekly payrol checks (w2 at end of the year) I think I will be laid off by July. I have a oppertunity to work for another builder but will be paid salary plus commision but it will be as a independent contractor (1099 ant the end of the year) If it does not work out and he lets me go in 3 to 4 months will I be able toi colect unemployment insurance?
