This kid has been living in Brazil for the last few year; that is all he knows.

It is terrible, but it isn't out of the realm of possibility, that this child wants to stay behind in Brazil. If this is what he truely wants, one will have to respect that.

Why is this different that Elian Gonzalez (sp)?

The U.S. held up his return to his Cuban father for months.

It is probably a fact that he thinks he wants to stay there. Yet he is a kidnap victim and his kidnappers have him. This is a well known effect upon victims. Famously Patty Hearst was a victim that bonded to her kidnappers. One does not "respect" the wishes of a 9 year old if it is against what his parent wants. Children do not have preferences in situations like this.
It isn't a family dispute it is a kidnapping.

Amen to that! This is a sad situation that was thrust upon this child. But at 9 years old he is incapable of understanding all the ramifications of the decision he is trying to make -- and adults should not be burdening him with such a decision.

Sean should be with his biological father -- morally and legally, that is the right decision.

Studies have shown that children are enormously resilient -- and adaptable. With the appropriate support, Sean will come through this.

Any decision in this case -- other than to return Sean to his biological father -- would be tantamount to the Brazilian government legalizing kidnapping, simply based on how long the captor was able to control the captive.

ITA This case should have been settled when the mother passed.

I'm pretty sure it was his "cousins" and the Cuban political establishment in Florida that held his return up.
The US Gov sent in a SWAT team or Seals or some proffessional Police outfit to remove the boy from the people holding him after the FBI could not negotiate his release so that he could go back to his father. His "family" and the Cuban Politicos and their patrons in congress held him here long after a judge ruled he should be with his father.
