CAFRA Deed Restricted
Independence Place seems to be one of the only developments that are Deed Restricted. This means we are under one of the toughest CAFRA Restrictions as it relates to impervious coverage.
As I understand it:
NO POOLS, inground or above ground are permitted.
Fences are being questioned.
Restrictions as to what type of planting you can do in your yard.
The total land was restricted to 33 1/3 Impervious Coverage and that 33 1/3 was utilized. This means the ratio of land to houses has been maximized.
Now if those who moved in first review the original Impervious Coverage provided by Ryan Homes you will see that there was no disclosure of Deed Restricitons. So, those who have paid 10K, 15K, 20K extra for prime property, basically invested in property they cant fully utilize.
Now with all being said, I believe misrepresentation was given and those who did pay extra for their property, probably do have legal recourse to be compensated for the loss as they are restricted just the same as any other home owner in this development.
A cost for a permit from CAFRA can cost up to $300.00 and that does not even include any money spent for an Engineer to come out, survey your proper (which is needed by CAFRA for any permits).
I am continuing to research on CAFRA and what restrictions I have with my own property and will continue to share with others what I find out.

I don't really get why Independence Place is so restricted under CAFRA. I am not doubting that it is, but why is it?? I thought tough CAFRA restrictions were for wetlands? What is it about Independence Place? When the adjacent Kara homes were built, did they go through the same thing? Just curious, it's not like you guys are on waterfront property. Seems like they kind of went overboard with these restrictions.

CAFRA Restriction
I was told that it has to do with the ratio of homes to the percentage of land. I'm waiting on a response back from CAFRA and hopefully I will have more information to provide to everyone. All I know is that Independence Place is the most restricted development in Barnegat. It's very upsetting since I did not know we were Deed Restricted prior to closing and had I known, I would have never purchased here at Independence Place. If you research CAFRA website you will see that Impervious Coverage covers a broad range of areas. There are exemptions to Impervious Coverage, the only problem the exemptions may not apply to Deed Restricted areas. It's a shame!!!!

CAFRA Update
I spoke with the State and found out the following:
We do not need to get a permit through CAFRA for the placement of a Fence, the permit needs to be obtained through Barnegat.
For those with Children, Swing Sets and Sandboxes are not considered impervious coverage and should not be an issue.
There are no restrictions for Fertizing the lawns.
We are allowed to plant anything we like and as for the reforestation area, this is overseen by Barnegat.
Shed, Deck, Patio, Pavers, Pools are only allowed within your modified CAFRA Box with a permit through Barnegat. Anything outside of the box needs to be done through CAFRA.
Now obtaining a Permit through CAFRA is another issue on its own since the entire development is under one Permit and that Permit does not expire until January 29, 2009. This means, if we want to obtain a permit prior to that time, we would need to do it as a modification to the existing permit. Since not all the houses are built, any modification is going to be impossible.
Also, an Engineer Design is required for a permit through CAFRA and the cost for a permit can be very expensive.

I see there are back stairs at High Pointe. I am pleased but the kids still want a zip line instead!

Hello everyone! new to the boards. I'm looking at buying in Independence Place and wondering if anyone can tell me whether it is okay to build a deck now? I don't care about a pool. All I want is a deck, fence, and shed. Anyone have any insight?

Deck Ok...Fence Ok, shed is not an option due to CAFRA restrictions.

Hi, Is there anyone still having problems with their Ryan Home? I am considering a class action lawsuit for my house in Independence Place, is there anyone out there with me? I need to get everyone together to lower our attorney costs..

I can't speak for Independence Place but we have been at High Pointe for over a year and are pleased. Also, FYI, there are 2 inground pools and a shed or two in the neighborhood here.
