Anybody can be sued for anything. However, your chances of being successful in a suit against INS are extremely remote. The government has immunity from suit, and the circumstances in which that immunity can be considered waived by the government, or that are exceptions to the immunity doctrine are few.
Most illegal immigrants are here to work, and do not cause problems. There are a few exceptions, but I think all the anti-immigration hysteria these days is thinly veiled racism.
