Default Deming - Ordinance 37?

Does anyone know if the minimum is 2 acres to build? I have 1 acre my parents bought in 1950 and I've held on to it but am not sure whether to sell or keep it longer. Any insight is appreciated?

From what I gather from a Deming Realtor, Ord. #37 requires 2 acres for installing a septic, but won't take effect for two years yet. I haven't seen the ord. yet, but will soon.

So it seems then that Deming, within the political boundary, which is connected to a sewer system, would be exempt. The outer boundary, or areas planned for annexation (unincorporated land) would be subject to such an ordinance?

It was mentioned by a landowner that if the lots were sold as buildable but now aren't then they shouldn't be taxed. Quite a few interesting comments from the public at that meeting. I'm absentee and will probably just hold on to the property as I can't do anything with it the next couple years. Thanks again for your reply.

LGC--- I'm in the same boat with less than 2 acres and absentee. But the taxes are so low that I'm going to keep it for a while. My Dad bought it in the 60s and if nothing, is a good conversation piece. Just beware of and outfit (not sure of the name) that is advertising direct with an "offer" to buy the property for an insane amount of money, they only want to list it for you for sale at an outragous cost.

I own 1 acre AND I belong to the landowners association. It is very interesting to read about the landowners that came to the city meetings to protest the enactment of ordinance 37- all in vain! The landowners association has an attorney and I think they are taking Deming to court!

Months ago I received a postcard from some outfit that wanted to buy my acre for $200!

Overall, I have to say I am favor of Ordinance 37, at least in spirit. That being said, this is how I understand it:

2 acres and above, you can install a standard septic system on your property.

Under 2 acres and you have to install an 'advanced' septic system, i.e. more money.

As people trickle in and start building on their lots, the waste water from those homes has to go somewhere and the water table is only 150' underground. By the time there are enough homes to justify/support a sewer system, who knows how much waste is being filtered into the aquifer. Think about that can of paint or bug spray in your garage. If it spilled into the drain, no big deal, right? It's just one gallon.....but I have 71 other houses in my neighborhood. If we all spilled at once, that's a 71 gallon impact on the environment.

Secondly, Sunshine Valley Ranchettes is a HUGE area and I have an acre down in Unit 19. How long would it take the county to run a pipeline out there?

Lastly, what about privacy? Even at a 1/2 acre, those wide, open spaces will seem a little cramped if everyone on your street threw up a house.

I'm not saying that Luna County has a great solution to all this, but I would like to think they are thinking about the future quality of their County. There are a lot of subdivisions here in Phoenix were a builder tries to squeeze out the maximum dollar out of every square inch of land. I do not want to move out the the country and have my neighbors stacked up on top of me.

Also Ordinance 37 has made it so if you have under 2 acers of land in the county, You must put in a advanced Septic Sys. cost from 8,000.00 to 16,000.00 and a 2 year Maintanence Contract so in my Opion the Commissioners have made in Luna county. Land Under 2 acres Useless and unsellable. In My Opion Real Crooks ,Rick Holtridge is a Commissioner also a land Developer, who Voted this Ordinance 37 in. with only 2 other Commissioners. Against the will of almost all the People who Live in Luna county.On Sept. 27 2006 There was a Public Meeting and the Deming Dimlight reported over 500 people were at the meeting, Everyone who was at that Meeting Spoke out aginst this courupt ordinance 37. and we have the Video But the Deming Dimlight. Was all in favor of the Comminissioners, I am sure what they printed was becawes Scott Vinson (the county manager) Son Was Going Out With the Reporter of the Deming Dimlight. 3 Comminissioners Voted this Ord.37 in aginst the will of the people, and most land owners who live out of luna county Still Don't know what they done to here land rights. also you can't Park you RV on Your Land anymore without a Building permit and if you do get the permit With the Advanced septic sys. and power and well you can only leave it there for 3 months That is what I have read about this ord. Real Crooks in my opion. The State Of New Mexico is only going to 3/4 of a acre in 2008 to put A home on your land But Luna county has gone to 2 Acres to put your home on. and any thing under that if they will give you speical Permits you must pay for this advance Septic sys. 8,000. to 16,000.

Luna county and the City of Deming is Using this Ordinance 37 . or a ordinance Simlar ,To Run the Poor people out of the county and City and Make People Homeless. Some Without civil Rights of Due Process.and DESTROYING PEOPLE and there Families Lives.This in My Opion There is nothing Diffrent then any other Land Grab By Crooks. Not 1 person wanted this Courupt Ord.37 put in at that meeting. ecept Rick Holtrige (the Main Luna County Commissioner He is also a Land Developer )and his Buddies.Almost everyone said this Vote should go to the People, But In my Opion I am sure Elections are Rigged Here, so it wouldn't have made a diffrence. But only 3 land commissioners Voted it in here.Aginst the will Of the people. They Claim there is 88,000 lots here in luna county. It has Been Over 1 Year Sence this Courupt Ord.37 was Passed. The County Has NOT Notified the Land owners who Live out of this county anything about this ord.37, So when land owners Come here to build on there own land that they purchased many years ago, and they Find out That there land is Useless and Unsellable ecept for Pennies on the Dollar, EVERYTHING UNDER 2 Acres. I don't think they will be very happy. Also just to let everyone know in my opion and what I am seeing ,this county Luna ,has put so many Diffrent things in this Ordinance Unless you and your Family are Absolutely Perfict Or Good Buddies with the commissioners or code enfocers, They can Steal your Land and home any time they chose. This county Needs to be a Referendum County or it should Be ReNamed THE SECOND RUSSIA, in The U.S.A.
