Not gonna happen. Doesn't really sound like anyone's doing anything illegal - it's just the decline of our culture.

I really feel for you people as I read these posts. I can't even stomach going to the Wal-mart in our small town because these types of people repulse and annoy me so much. Can't imagine being crunched in like sardines with them. I couldn't do it. I'd be in the nuthouse before too long.

While it may be "considered fraud", mta employees are only permitted to ask whether it is a service animal required because of a disability. You may not ask for certification, papers, or proof of any kind. You are not permitted to ask what the disability is (that is a violation of the ADA). And I suggest that if you do have the person and service animal removed from the subway because YOU don't think the animal is performing a service, then you personally as well as the city are subjecting yourself to a civil lawsuit.

"You may have the service animal removed from your facility when that animal's behavior poses a direct threat to the health or safety of others -- only. You may NOT make assumptions about how a particular animal is likely to behave based on YOUR past experience with other animals."

This link specifically states only 2 questions you may ask: Is this a service dog OR does your animal have legal allowances and Is the service animal required because of a disability.

Anything else you ask is violating the rights of the disabled person under the ADA.

Throw me off your train because you don't like how my dog is behaving and I will make it a federal case. I expect my dog to be aware of what is going on around me, specifically anything my dog perceives to be a threat to me since I cannot hear what is going on.
