They will not take NYC tax from your paycheck unless you tell them too but you would get it refunded if you did pay it. This is a resident tax and is only for people who actually live in NYC...if you live in the suburbs or anywhere ouside nyc you will not pay this.

NYS tax is different, it is a true income tax...not a resident tax like NYC. Anyone who earns income in the state of new york will pay this. For example, even a baseball player who plays for a chicago team will pay this tax for their 2 or 3 days of work in NYS on the income they make in those 2 days. All state income taxes are like this.

Does anyone live outside of NYC and get the resident tax refunded? It would appear there is no way around the NYS tax even if I am working outside the state.

My plan was to take up an address in NH and telecommute to NYC, while traveling around the nation for a consulting firm. I just don't feel like I should have to pay NYC and NYS taxes if I am never there.

Yes...I used to live in longisland and work in manhattan. You do not pay the NYC tax there as it is for residents only. Do a google search for form IT-2104, this is the new york state version of the federal W-4. You will see on the form, and you must fill this form out once you start a job, that you just have to check NO to the "are you a resident of New York City" question. Then your employer will not withold any NYC taxes. It's that easy.
