Hi Everyone,

Like the title says can I have 2 leases under the same name on 2 different rental apartments in New York City? And if I were to sub-lease with an okay from building management, will I have to have the sub-lease apartment as my primary address? Thank you.

You can lease as many apartments as you can afford. Primary address has nothing to do with it; you could lease two apartments and have a primary address in California if you had some reason to (and spent more than half the year in California)

As long as it meets your budget, you are free to enter into as many contracts with landlords as you wish, though if the apartment is subject to control, i.e., stabilized, or rarely, rent controlled, there are limits as to what you can do with respect to subleasing the apartment, including caps on what you are allowed to charge.

Read this information from the RGB if the apartment is subject to control, as it governs your use of the property with respect to subletting: NYC Rent Guidelines Board

It is illegal to rent more than one stabilized or controlled apartment. That kind of shenanigans got even a NY Congressman in trouble (Rangel.)


With market rent apartments, you can have as many as you desire and can afford...often one for each "special friend."

Keifer King is correct, you cannot rent two rent controlled/stabilized apartments.

Your primary address MUST be in NYC. You cannot sublet w/o the LL's expressed permission.

Market rate nonstabilized apartments are subject only to the lease rquirements and you can rent two apartments. Yet, again, you cannot, generally sublet w/o the LL's approval, and you are not allowed to profit from the Ll's property beyond the legal compensation. In effect, you cannot profit from the LL's property.
