Fire Escapes are not built to endure lots of stress of people on them. They are to remain clear 24/7.
It's a right of all tenants to use them for safe egress, not a privilege balcony.
Call your landlord, 311, or if it escalates at night NYPD.
You know my girlfriend and I was just wondering the same thing yesterday when we saw a few people hanging outside their fire escape. Some apartments put easy to access doors for people to treat their fire escapes as a balcony.
Personally I don't think its illegal or even addressed. And since you live in a rent stabilized building it just makes it that much harder to enforce. Because I know the landlord cannot get rid of me that easily anyway. But either way I'm curious of the response you get from fdny forum.
well it's a problem when they're making a lot of noise out there and they refuse to pipe down, regardless of whether it's illegal or not. If it IS illegal AND they're making noise on to of that, then they're in deep doodoo.
When telling your landlord / mgmt company, be sure to emphasize how much of a liability issue it is for them. You being annoyed will do very little in getting them to do anything
I lived in a 4 story, 32 apartment joint where there were teen parties on the roof most Summer nights. Of course, only 5% of the kids lived there. The rest went up and down the fire escape all evening past my kitchen window. It gave me such a sense of security to know that when I was out anyone could break the glass and come in.
For fun, the kids would throw beer bottles off the roof and rip off TV antennas.
I remember that in the previous building I lived there was a woman in the building across from me who would often have her daughter sitting out there. She would also join her from time to time. It seemed like the daughter had ADHD and being out there calmed her. Anyway just thought that was interesting to add. I'm pretty sure FDNY frowns on that kind of use of the fire escape. Your not even supposed to put anything on it.

Sure it's not a balcony? I honestly have never seen a door to a fire escape.
