2 Idiots in the apartment below me were hanging out in the fire escape and talking very loudly last night around 12pm. One attempted to climb up into my area. I caught him and told him he shouldn't be out there.He climbed down below me and continued to loudly talk with his girlfriend.My window was open and they were obnoxiously loud.They didn't seem to get it. Their voices were getting louder and louder. I finally I yelled down to them and told them to stop making the noise.

Are they allowed to use the fire escape as their personal balcony? It's a rent stabilized building. I though it was illegal for people to hang out there. I just want to get some sleep without these bozos yapping all night.

I don't think it's actually illegal but would certainly be frowned upon by the LL as it's creating a disturbance and a safety and liability issue if someone falls. Tell your Landlord about it, As you have a right to enjoyment of the apartment and it is affecting your living there.

D. Scott, thanks. ok. I am going to ask FDNY. I know placing items on there is illegal. I am looking it up in the Fire Code and can't find anything.Can't find anything about people hanging out there. I think they were drinking there too.

You are welcome. If they are drinking then there is a risk of bottles/glasses or even themselves falling over the side. The landlord will give them a stern warning at least if he has any sense.

Considering the city we live in there has to be some type violation against it. I've lived in a building where the mgmt company gave out notices against using them as personal space.

They told me.."then close your windows..." after I told them to cut the noise. I said.."what..? are you for real?" I threatened to tell the landlord if I see this again. That's when they went inside and it was over. My friend told me to threaten to pour water over them if they don't quit it. I kind of don't want to do that although it sounds like fun.

They were just really obnoxious and rude. Let's see what happens tonight. I started keeping a log already. Just in case they continue this.

Hope this gets straightened out soon Mystique13.

Living in buildings can be daunting. Between noisy neighbors and dirty ones it really impacts the quality of life. People hanging out on fire escapes and in the hallways and leaving trash everywhere brings vermin and is just ugly to look at. Point is, Home, Including the building should provide a nice refuge and escape after a long day.
