Its easy to pass judgement.

My lawyer attempted to contact them everyday, the selling agent and lawyer on their end never picked up the phone. They eventually sent a letter to return the contract and the check for the deposit. The letter states that they found a different purchaser with a higher offer. Such a dishonest and shady agent. They sat on my contract for 2 months without acting on it, I'm assuming either of two things happened... 1) The agent wanted to be on both sides of the deal and found his own buyer for the unit 2) they had a slightly higher offer on the unit, but delayed me to vet the other buyer before rejecting me. We were dealing with an unscrupulous agent, there's not much we could have since they did not sign the contract or put the deposit in escrow.

It is absolutely unethical but there is not much you or your lawyer can do about it. Happened to us once when purchasing co-op in the city (while the seller's agent is actually from Forest Hills). The agent was sitting on our contract for few weeks and then rejected us as I later found out because of higher all cash offer. However, the board did not approve that all-cash buyer and the agent has to start all over again after three months (karma is a b..!). We should probably identify those agents - NYC needs to know its heroes by names!

When you run into crap like this it is time to move on to the next, more reasonable offering.
At the first whiff of illegitimate unseemly behavior on the part of a seller, any potential buyer should pull out immediately.
There are plenty of fish in the sea, and almost as many real estate offerings.
