Month to month tenant rents 1 flr of my house is still currently living in Also has access to my detached garage I wanted to protect and prevent damage to my house floor Gave him a key to store his bulky heavy things or whatever junk in there He got no lease contract agreement or anything for the garage but refuse to move his things out from it and or give the key back to me Tried to talk to him but all he does is taunt me Is there anything I could do to take back my garage?

^Change the garage locks?? Can I really? Can't he call the cops on me for it? Also forgot to mention will have day at housing court for his eviction Would it look bad for me to change the garage locks right now? The reason I want to take it back is because he stole from me

He has no lease, which means he has nothing in writing saying that he has use of the garage.

You cannot change the locks to his bedroom, because he is paying you for that bedroom. With the garage on the other hand, you were simply doing him a favor by letting him store some of his things there. Unless he has a lease that states in writing that his rent includes use of the garage, then that favor can be revoked by you at any time.

Do you mean I write one on my own? Or I have a lawyer send one to him?
