If the wife is not working, and the husband is making about $40,000, is it possible for them to file their tax return separately, and the wife can claim for public welfare? I am asking this for a friend of mine. The husband annual $40,000 is not stable, but is an estimate, so just want to find out how this might work.

When you file separately you indicate that you are "MARRIED filing separately."

If you file claiming "SINGLE," you are committing fraud. The IRS may not care because you will wind up paying more tax but welfare agencies may sniff it out. All of this is public record available with a keystroke.

Tell your friend to not entertain the option.

IRS probably won't care if a married person files a single. However if you are doing so to produce tax returns to defraud a government agency better think again.

You may get away with it initially or for awhile but an audit or if someone drops a quarter on you and *welfare* finds out....

There are ways to do this, but your "friend" would have to hire an expensive accountant which would eat up the profits of the scam...
