Report: The NYPD Is Failing Vision Zero: Gothamist


The NYPD is failing to adequately police reckless drivers even as cyclist deaths and pedestrian and cyclist injuries climb, according to a report issued today by Transportation Alternatives [PDF].


Between January and May of this year, 5,588 pedestrians and cyclists were injured in traffic, up 11.6% from the same period last year. Pedestrian deaths have decreased in the same period—46, down from 51—and cyclist deaths have doubled: 14, up from seven.


There have been 22 fatal hit-and-run crashes this year, up from 14 at this time in 2015.


Summonses for speeding and failure to yield—two offenses that often factor into a serious crash—were up between January and May of this year. Department records show that cops issued 18,993 summonses for speeding and 16,461 for failing to yield between January and May, increases of 15.3% and 16.5% for the same months, respectively, in 2015.


But today's report suggests that on the precinct level, some officers seem to be prioritizing the wrong infractions. In Brownsville, for example, cops issued 1,257 summonses for tinted windows between January and May, compared to 85 for failure to yield. In 32 precincts, officers issued more tickets for tinted windows than for speeding and failure to yield combined.


Other precincts are devoting "disproportionate resources" to cracking down on cyclists, according to the report's authors. Although the NYPD started issuing moving violations for riding on the sidewalk in 2014, criminal summonses outnumbered the less-consequential violations 1,858 to 1,655 last year. In the 79th Precinct in Bed-Stuy, cops issued 146 criminal summonses for sidewalk riding, compared to 2 moving violations.


And when a hit-and-run driver struck and killed cyclist Matthew von Ohlen as he rode in a Williamsburg bike lane earlier this month—cops have said the driver may have done so intentionally—locals noted an uptick in red light and jaywalking tickets.


"Data-driven enforcement is a part Vision Zero, but the NYPD is not doing data-driven policing," said Transportation Alternatives Director Paul Steely White. "Instead they are policing by some historic bias that I don't understand."


In some precincts, an increase in summonses has lead to a decrease in crashes this year. In the 5th Precinct, covering Chinatown, speeding summonses more than doubled in early 2016, and injuries dropped 5%. In the 111th Precinct, covering Bayside and Fresh Meadows in Queens, speeding summonses increased 52% and failure to yield summonses 42%, with injuries down 15%.


"Speeding and failure to yield pose the greatest risk to pedestrians, cyclists and drivers," mayoral spokesman Austin Finan said. "Our enforcement efforts are laser-focused on reducing these dangerous driving behaviors and making our streets safer for everyone."


However, 17 precincts, primarily in Manhattan and Queens, saw a decrease in speeding tickets in early 2016. In Manhattan North as a whole, speeding summonses are down 19%.


"The variability in ticketing practices as shown by this data indicates that there is no unified, citywide Vision Zero policy and protocol," Transportation Alternatives writes. "Consistent, predictable enforcement is most likely to have the deterrent effect that changes behavior and saves lives."
To address cyclist safety issues, this year the NYPD has launched an initiative called Bicycle Safe Passage. For four-day stretches in May and June, precincts across the city cracked down on drivers blocking bike lanes, as well as those who failed to yield to pedestrians. More than 800 failure to yield tickets were issued in June, as well as 1,086 red light tickets and 1,757 tickets for blocking a bike lane.
Mayor de Blasio called 2015 the "safest year ever" on NYC streets, with 134 pedestrians killed, versus 139 in 2014 and 183 in 2013.


"We've regularized enforcement of the most dangerous driving behaviors, and the numbers bear that fact out across the board," said Finan, the mayor's spokesman.


Transportation Alternatives called the Safe Passage initiative a "welcome, if short-term and occasional, move," adding that the data doesn't include breakdowns by precinct. It also doesn't indicate whether cops are focusing on the most dangerous streets and intersections.


"We're not asking for more enforcement or summonsing in general. We're asking for more precise summonsing of the most egregious infractions," said Steely White. "This is a sharp contrast from enforcement activity that's based on suspicion or bias."

This might explain it. Pedestrian deaths are down, but cyclist deaths have gone up. There is an increase in the number of people riding bikes (and now what with Citibike) since V0 was launched and it is difficult to police their safety.

Deblasio should just come out & say Vision Zero is really a money grab. Its all about getting more tickets & a publicity stunt to look good.


Personally, I never got a red light ticket or speeding camera ticket....but this 25 mph speed limit is really ridiculously too slow.

Not surprised with cyclists deaths going up, I always see them doing careless things like blowing threw red lights and swing around streets, not staying on the side that is going in their direction etc. It's especially dangerous at nighttime when some bikes don't even have lights equipped.

I expect Deblasio not to do anything about it and just continue to punish vehicle drivers instead. Can't wait to vote him out next year.

I only got a ticket once before, and that was for double parking.

I don't mind side streets or streets like Myrtle Ave. Fresh Pond Rd, Grand Ave, having speed limits of 25. But it bothers me when major arterial roads like Atlantic Ave & Queens Blvd have 25 mph speed limits. Small residential side streets in Nassau County have higher speed limits then that.

^traffic is generally so heavy on those side street listed there...25 mph is fine. As you noted, driving 25mph in major road in queens...then it goes 40mph on the Long Island side.....its quite a jump for me.


The other scam is cars exiting highways at 60mph off the ramp...to 25mph on the service road. Sometimes the cop sits there waiting to give out more tickets. Many of these exits are quiet with no pedestrian anywhere.

There's a stretch of Metropolitan Avenue that runs through St. Johns cemetery for about 8-10 blocks that had it's speed limit lowered from 30 to 25. It's a 4 lane street with virtually no pedestrian traffic ( there's not even any sidewalks here ) and yet not only did the DOT lower the speed limit of this stretch from 30 to 25, but they often have police sitting by the entrance looking to pull people over for tickets. That pretty much convinced me that this is all just to screw middle class people even more for money.
