I'm wondering if anyone has any insight on whether or not I would be allowed to sell baked goods (cookies, cakes, cupcakes, chocolate covered things etc) that are made out of my home over the holidays? I live in Brooklyn, I was under the assumption that I do need to get a license (food handling) and home processing exemption...is there anything else?

Should I start an LLC so I'm not liable if someone becomes ill? Hopefully that would never happen. Insurance? I would be the sole person operating this, I don't plan on hiring anyone.

This wouldnt be a full time thing, or my main money maker, I was just considering doing this during my free time to make some extra money.

I would appreciate any advice at all!

Yes, if you want to do the thing legally you'd have go through the official process with City and have various inspections, get permits, etc....


OTOH plenty of people men and women sell baked goods during the holidays totally under the table.


You need a license and so forth to sell booze, but plenty of folks sell coquito around the holidays out of their homes or whatever.

You'll probably be fine as long as you don't wipe out a neighborhood with salmonella poisoning.

Basically it's not possible to do this legally, you need a commercial kitchen and a staff.

Just sell your holiday cookies and not worry about it. Just don't sell them to any lawyers or lawyer wannabes. You can smell them a mile away.

Most of the folks that does this are just office workers looking for a few bucks but to do this in any larger scale you'll need to obtain a license.
