The floor in the bathroom is weak and broken. Do you think he will raise my rent/ charge me for the repair.

Why would he? Did you report the situation when you first realized it occurred or did you let it worsen and then report it? Either way it's a general maintenance issue that you should not be charged for unless you caused it doing something crazy and it's not part of general wear and tear.

either tell landlord and have them fix or call HPD and report the problem. HPD will issue violation to landlord, and force him to fix.

No, that is a structural issue and comes under warranty of habitability. Let your LL know by telephone, email or letter and follow up until work is done. That is a dangerous situation with people and or things (such as the commode) known to fall though fall to apartment below.


However you didn't state if this is a rent controlled or free market unit.


If the latter and say in a two family house the LL *may* try to up the rent at next renewal to recoup his outlay for repair work. Yes, it wasn't your fault and you had the right to have things repaired but some LL's feel someone other than themselves needs to pay for such things.

A good LL would always make sure they are making enough on a property to cover repairs on wear and tear. And a good LL would continually raise rent to take account of maintenance.

Condo and co-op owners pay maintenance fees rolled into their mortgage. Keeping an apartment up to par, due to tenant wear and tear is a cost of a business. However a smart LL, would always find ways to recoup that cost through the income property.

If you're rent stabilized, landlord cannot claim this as a "major capital improvement," which includes such overhauls as a new roof, a new boiler, replacing the wiring throughout the building (you get the idea). This is general maintenance, and the landlord will get a contractor to do the repairs. He can't be forced to match the tiles perfectly, and if the building is old, it's not likely they will match. But landlord has to repair your broken bathroom floor, and if you're under rent regulation, this wouldn't be a major capital improvement that would allow LL to raise rent for this one repair.

When you contact LL, it's helpful to include a photo of the damage (taken with your phone) with the query, which I assume you would be sending by email. Now, if you want an upgrade to your unit, say a new bathtub when the one you have is not damaged, your rent can be raised (there's a formula for it--this would be for something your LL is not legally required to supply, and is not applicable to the repair you're requesting, which is required).
