I don't think it would be legal if he does a switcheroo and makes the two legal apartments into one and then makes the basement into an apartment (without dealing with the authorities first).

if thats the case then he would need to file with the Department of Buildings and do some work to convert it.

I have a couple of questions:

1. I currently live in/rent the basement of a house; how do I determine if it is a two family or single family home? There are two floors above me with two bedrooms on the top floor. I doubt that when they made the basement into an apartment that they filed a new C of O. Only one driveway. one garage, but a separate entrance to the basement apartment?

2. If you are going to convert a basement into an apartment, don't you also have to have a separate meter?

It's illegal, like all basements. If you get lucky and the inspector doesn't come, you can stay there. This happened to me 2 times already in Queens. I had great basement apartments (large and cheap) and someone reported them and I had to move out.
Now I'm paying more for a small studio apartment that I Mod cut: languagehate.

but what if the landlord is renting a basement to a family who has two kids younger than 3 years old? is it legal?

the basement is about 3 feet above ground so it does have small windows. has private entree in the back of the house has a 1/2 bathroom and a small kitchen. however its kind of small in sq. about 24 feet by 20

Hi, i'm renting an illegal basement with a one year lease. When i sign the lease i didn't know that the basement was illegal. I was told by the landlord after some time. On my lease it stated that i should put the electricity in my name and i was also told the same thing by the real estate agent who rented the basement to me. But when i spoke to the landlord she told me that the basement did not have a separate meter. Now months later she's showing me a bill for $800 in electricity bill. What should i do? Can she take me to court for the bill?
