Default Basement issue, Queens

I received a notice that my basement was illegally converted. I purchased the home almost 4 years ago. It was appraised at that time with a semi-furnished basement with kitchen, toilet with standing shower and bedroom. I have not made any modifications to it and used it as a storage room and personal use.

Can I show the Department of Building inspector when he comes the appraised papers when I purchased the home showing that it was purchased with the semi-furnished basement?

Would I still get a violation?
