Default Legal responcibility to a non lease room

O.k. I moved in just over 6 months ago. Day 1 i knew there was something wrong. Dont want to go into detail but neadless to say one roomate is scarry. The other roomate is afraid of her and doesnt say a peep. Roomate one is steeling from me. I waited a few months because i wanted to be 100% sure of this. I asked her not to do it anymore and she went LOCO!!!!!! I am affraid of my saftey at this point. I found a new place that I would move in in two weeks.

My question...
The deposit is less than a months rent and I am not on the lease. Legally If they can get another tenant will i get my deposit back & if they don't am i responcible for the entire months rent?

Your situation highlights the potential and actual unpleasant issues involved with roommate situations. Unfortunately, for many, many, there is no alternative if they wish to live in the Big Apple.

Since you're not on the lease, it seems that your deposit is in jeopardy. Of course, oral contracts are enforceable but proving that there was one and trying to enforce it would cost more in time, aggravation, money than the value of the referenced deposit.

As miles says, it might be hard for you to get your deposit back.
and since your name isn't on the lease, you don't have to pay rent at all. . lol

Best thing to do is move your stuff out asap so things wont get taken.(since you wont be paying rent.)
