and actually it was an application that I had sent for addmision. on the back of the application, there is a few instructions and the max stay. every resident has to fill out the same application. it is the same format and the same application.
I am not complaining about being forced to move out after my contact is up. I am complaining that they don't force others to move out like they did with me. it is not fair and it makes me angry. I have done nothing wrong really.

4 years ago she might not have filled out the same application. Even if she did fill out the same application, they can let her stay and ask you to leave.

It's not fair, but it's not illegal.

are you sure this is not illegal? because it is clearly a discrimination??
the rules of the house are CLEAR. no stay after two years. this woman IS the adminstrator but she is not the owner. she is putting me in a financial and emotional hardship.

I can see if this is an apt complex and the owner doesn't want to renew the lease to one tenant but can extend it to the other. that is understandable. what I don't understand is when it is a boarding house like this where is no way of extension to anyone. they put people in the street becasue they don't want to break " the rules" however they do break it.

I am not sure if I make any sense here.

Yes, I am positive it is not illegal. It is 100% legal to let someone stay and ask someone else to leave. It doesn't matter if it is a boarding house or apartment, they do not have to let you stay past the terms of your contract. It is not illegal discrimination to ask you to move out when your contract is up and let someone else stay.

You can call 311 but they will tell you the same thing. Move on and find somewhere else to live. They are not legally obligated to subsidize your apartment in any way, shape or form.

Ok. Thank you. I appreciate your inputs and actually it made me feel much better becasue I know for sure now that I have no choice but to keep my mouth shut till I leave.

Can i ask you if you are a lawyer? it sounds like you do have experiences in NY rentals regulations.

On another note, I was wondering if it is wise to rent a place from a management company that has a couple of bad online reviews? I actually went to the building and asked the other tenants a few questions and it sounds like there is no complaints but when I searched online, I have found a couple of bad reviews.

With regard to bad reviews, I might take those with a grain of salt, unless it's a clear pattern of them. Sometimes, you will find a tenant who has not had a positive experience with the landlord, though no fault of the landlord's, and they will write a complaint about anything.

Check the building for violations with the housing department, and check some of the other buildings that the management company runs to be sure that they are in compliance with regulations. That can be a good indicator as to the care that they take with the building, since few that take good care of the building would be horrible to their tenants, especially if current tenants that you interviewed have not expressed any ill will toward the company.

Also, check other buildings, if any, to see if there are similar negative reviews. If the reviews are substantiated by other buildings, and/or tenants, it might be a cause for concern.

I'd have to imagine that the boarding house has been through the legal process with all sorts of people just like you who want to continue living there past the term end that they've agreed on. Thus, I'd have to imagine that the contract you signed and the procedure they follow comports with the law in such a way that you will likely not have a claim. This is just common sense, right?

With that said, the only way to know for sure is to speak with an attorney. Why don't you contact, these people:

The link is to Eviction Intervention Services of NY, it is the first site that came up when I googled "eviction nyc". While, from their site, they tend to help the elderly or families with children, primarily, I am sure that they will refer you to some other, more relevant organization. Maybe they'll even take your case because it is irregular.

As for online reviews...you are only getting one side of the story and the people most likely to post something are the ones who were angry at the vendor/manager/restaurant/whatever. Take it with a grain of salt.

bmwguydc: Thanks for the link. I have checked it out and the building has a violation class A which means something minor like a leak or chipping paint which is VERY true. The apt has a cracked ceiling and I asked him for repairs. I don't know how I can find out what other buildings they have. I know only one building. the one that has the studio I am about to rent.

Gradstudent: thanks for the links. I might contact those people or I might not. I think I haven't made my point clear. I agree that it is their right to ask me to leave. All what I am asking them is to be fair. It just makes me angry that I have to spend a lot of money on the moving while other people are just enjoying their life there.
At this point, I don't know if it is worth the fight. I just need some peace of mind.

Viralmd, that woman just picks any resident to kick her out and she is hard headed. when I ask why?she would say " it is the rule. there is a max stay." last year, she kicked another woman out. this year, she chose me and someone else.

what pissed me is that she kicks people randomly and she keeps some other women in the safe zone. and when I asked her about one of those " lucky" women, because I know them by name, they are few, she said that she doens't owe me an explanation. and I believe she does. she is acting like she owns the place and she doesn't.

well, I know why she asked me to leave. becasuse I didn't kiss her **.
