I am a OH driver and 2 days before I was caught speeding in Owego, clocked at 88 on a 65mph. I was passing a truck when the truck started swaying so I had to speed up. I explained this to the officer but he asked me to defend in court. However the officer recorded my statement that "I was speeding but I sped to pass the truck" in the disposition attached to my ticket. I am pretty much responsible driver and this is my very first speeding violation. Now I am seeing 6 points plus fine. Could you guys help me in this? What is the best course of action? Will hiring a lawyer will help me in this? I can plea guilty and pay off the fine, but I am highly unwilling to do so because that's my rationale action (momentary speeding). Appreciate any help. Thanks.

If you want to fight the ticket you'll need to hire a lawyer specializing in cases like yours. Also, it could be that if you are convicted, the points won't be transferred to Ohio. Who actually stopped you, a local sheriff or policeman or a NY state trooper? See link.

Thanks for the response. My ticket says Officer of NY state police not sure if he is a sheriff, policeman or a trooper. In browsing thru forums, I see that NY DMV levies an assessment fee for 6 or more points. Will this be applicable in my case since I have Ohio license?

If it was a local cop who gave you the ticket, it may be possible to plead to a lesser charge. The NY State Police are less inclined towards leniency. Yes, you are subject to surcharges and court costs just like a New York State driver.


Why not ask your questions in the Ohio forum? I'm sure that there are plenty of Ohio drivers caught speeding on NY17/I86 and the Thruway.

Came thru Tioga County/ Owego today on 17 /86 . Its a speed trap zone that is heavily patrolled by State Troopers. I make the trip twice a month from NYC to the Elmira area.Very easy to do what you got ticketed for.Trucks will slow down enough to let you pass but then your speeding. I think unfortunately Ohio gets notified, only a few states don't reciprocate reporting speeding violations, over 30 mph the limit is a major violation so you're okay there. I would consult a lawyer, see if its worth fighting. In hindsight never try to explain to a State Troopers, they write down your statement, then have you sign it. They know out of state drivers are at a disadvantage to contest ticket.

23 m over the posted limit is a guaranteed ticket should you be noticed by local/or state law enforcement. I can
personally guarantee that.

There is a rest area just past the Owego exits westbound that is used heavily by the State Police and DOT for truck inspections. There is also a State Police Barracks in Owego approximately 100 feet away from the highway. Not a good place to go 23 mph over the limit.

Owego is where I'm from.
It is the county seat and is a small town, pop about 6k.
Yes, that area of NY 17/future I 86 is plagued by a large curve where you can't see them and by the time you do, they've got you.

The state police is who gave you the ticket, as the highway is their patrol.

See if you can plead down to " failure to obey a traffic control device" it's a 2 pt violation.

That's the best non-legal advice I can give you.

You can't do it via mail, you have to appear before the judge.

Next time you travel, do what I do: never go more than 5 miles over the speed limit, unless in heavy traffic where you are keeping up with traffic's speed.

Owego is essentially out in the middle of nowhere, is the largest town in the county (Tioga), and the county literally has more cows than people!

Of COURSE you are going to get caught going 23 miles over the speed limit, regardless of reason.
