When religion starts to infringe on the rights of an individual, it's the government's job to curtail that particular religious activity by deeming it "unconstitutional!"

Since the couples obtaining marriage licenses were not unable to obtain them, the closest thing to a right that seems to have been infringed is that of the magistrate to personally recuse on grounds of conscientious objection. Wouldn't that be a case of someone's "right" to marry being claimed as an excuse to override someone's right to religion?

A person's ability and/or willingness to carry out the duties of a job has nothing to do with religious discrimination. If a person cannot comply with the job description for any reason, that person should not be in that job.

If the job description changes midstream, I don't believe the private sector "grandfathers" people in their jobs, nor should the public sector. If there are vacancies in the organization that the person is qualified to fill, then make an effort to accomodate an existing employee who may otherwise be an asset to the organization. But don't leave them in a job they can't or won't carry out fully.
