A friend of mine bought a used truck about a month ago. Both him and the seller signed and notarized. My friend didn't get a chance to transfer the title into his name. The "buyer" is now in jail with no chance of getting out. The vehicle is parked at my house and i have the title because he gave the truck to me. How, in NC do i get the title in my name.

Your "friend" didn't "give you" anything more than a problem.
The simplest solution is for your friend to get the title put in their name
(and to pay the excise tax fees) and then to sign that new title over to you.

Next up is for you BOTH to go the DMV with the documents and another
notarized bill of sale for $1 and then between you to pay the excise tax fees.


The problem is in proving that your friend isn't a curb stone car dealer or worse.

he's in jail and not getting out anytime soon. I was told that since it is in my yard and both have signed and notarized the title that I could just put a lein on the title and claim it for money he owes me. I can't get him to get it in his name because of the circumstances. The sheriff told me to have it hauled off if I wanted to but it's not a bad little truck, I'm not trying to steal it or sell it or anything he told me to just keep it.

I'm confused. Your friend bought the truck, and both he and the seller signed the title. Who is in jail? Your friend (buyer) or the seller? Who gave you the title?

the buyer is in jail. the seller signed off and my friend wrote his info on the title and they had it notarized. Its a totally legit deal its just that my friend didn't transferbit yet. hes only had the truck about a month which i know is plenty of time to have registered but he didn't. the only reason i mentioned that is because it's not like he's had the truck for a year and just didn't transfer iit yet. But i think he knows hes going away for awhile that's why he just gave it to me. and I can't get him to do anything so I'm confused. I could file for an abandoned title but that's kind of expensive.

He didn't know he was going to jail a month ago? Anyway, you have quite a situation. I don't think there is a simple or inexpensive solution. I'd recommend going down to your local DMV office and ask them what the procedures are for resolving it. I'm guessing you could complete the transfer into the buyers name, but then you would need his cooperation in order to have him sign the title over to you.

He gave me the truck so I don't know why he wouldn't cooperate. And as far as whether he knew or didn't know is irrelevant. I only stated it because it's major problem. I don't want to discuss someone's business especially online. I think you're right, the only for sure way is to contact dmv. it Will probably require getting a power of attorney in his absence and follow through with how the title is and put it in his name then mine. I'm going to also research my putting a lein on the title.

You said "I can't get him to do anything" so I assumed he wasn't willing to cooperate. I would think there is a way (probably through an attorney) to get a title to him in jail and have him sign it, but maybe not.
