Can the police keep my car? My son got arrested the other night for having 1 joint on him and some drug paraphanilia (scale). He spent the night in jail and they towed his car away, or I guess you say impounded it. Can they now keep the car?

1 joint and paraphernalia are MISDEMEANORS - so let's not jump the gun. Hopefully this is a huge wake up call for this parent and the issue will be handled. Meanwhile, no, they will not keep the car except in felony cases - you just have to pay like $150. to get it out of impound I believe.

You'll get a notice where the car was taken, and you'll have to pay towing fees and storage fees.

That said, I agree with LovesMountains and LRoyal.

§ 90‑112. Forfeitures covers when they can keep you car. It states that "No conveyance shall be forfeited unless the violation involved is a felony under this Article." If the NORML site is right, this isn't a felony. So, no, they can't keep your car forever.

You need to make some calls and get your answers immediately. There are situations where they tow the car and then charge you a daily fee until you pick it up!!! So make sure the car isn't just sitting there, racking up a daily fee that you will have to pay!!!

Was this Buncombe County by chance? They are infamous for this kind of crap. To the guy that posted the b.s. about your son being a drug user... get real! I bet you never smoked a joint or had a beer and got behind the wheel or did anything wrong when he was a kid. Gotta love those idiots!
