For those who don't feel like clicking on the link:

In addition to the legislation mentioned last week, NRA is working with State Representative Mark Hilton (R-96) and State Senator Andrew Brock (R-34) to introduce “Castle Doctrine” self-defense bills, which will seek to allow law-abiding citizens to use the force they deem necessary against a violent criminal attacker to protect themselves wherever they have a legal right to be. The bill also provides civil immunity for those who defend themselves from criminal attack.

You mean this wasn't already law? ??

I thought NC already had a home defense law too.

Current NC Law: § 14‑51.1. Use of deadly physical force against an intruder.

(a) A lawful occupant within a home or other place of residence is justified in using any degree of force that the occupant reasonably believes is necessary, including deadly force, against an intruder to prevent a forcible entry into the home or residence or to terminate the intruder's unlawful entry (i) if the occupant reasonably apprehends that the intruder may kill or inflict serious bodily harm to the occupant or others in the home or residence, or (ii) if the occupant reasonably believes that the intruder intends to commit a felony in the home or residence.

(b) A lawful occupant within a home or other place of residence does not have a duty to retreat from an intruder in the circumstances described in this section.

(c) This section is not intended to repeal, expand, or limit any other defense that may exist under the common law. (1993 (Reg. Sess., 1994), c. 673, s. 1.)

I think this is an important difference that we don't have with our current law. Currently we have a duty to retreat if we aren't home & we can't stop a thug taking our tv, only if we feel that they are going to kill us.

great law, but for the new folks in nc that are from the north east have no fear this will make you safer dont bash common sence gun laws keep the criminals guessing the more people that have a gun on them legally, the better it is for everyone, i wonder if the folks up in blacksburge va now wish that a student legally possesed a firearm that day what could have happpened, how about the folks in that mall in omaha neb. last year? so you will be safer w/ a right to protect law

Great news - I support any laws that allow the law abiding citizen protection over the criminal elements and criminal acts

We have had the Castle Law in Florida for a few years. Everyone was afraid people would just start shooting everyone. Well, they didn't. And the important part is the protection from civil imunity. There was a case down in Florida years back when a armed robber entered a home. The owner had time to get his gun. Seeing that, the robber fled but tripped on the steps outside and broke his leg. He sued and believe it or not won. I think it was overturned later but the poor homeowner had to put out a ton of money for lawyers. Anyway, hope this passes here in North Carolina.
