Hi i meant that since my second year will end in late April
and i do NOT qualify for any extensions this year (based on 1.5)
they should pull forward me for Tier 3 and Tier 4

I wasnt sure if (since its a pull forward) if that AUTOMATICALLY happens or not or if u have to call and get someone on it

i havent gotten a Tier 3 letter (because i dont qualify UNTIL they pass the extension extension, and i doubt ill get one since im sure NCESC will be swamped with things to do) so i didnt know if i should call a local office? or raleigh to ask about it ?

I did that once before during my first letter I got 2/23/10. and he was looking at the screens and had to get a supervisor to look at never heard anything. so I kept calling and they told me I would be added to tier 1V cause of a pull forward. what was left on my old claim which would be tier1V cause they told me I went through tiers 2 and 3. since my benefit year ended feb. 6th. I went to the esc and they refiled my claim.for me. Since the new year came up for filing they told me that I wouldn't be eligible for eb cause it's a new year and you would not get it cause a pull forward. I have been on unemployment since february 2008 so I guess I have exhausted benefits. but in 12/30/2009 I got a letter stating that I would receive eb for 14 weeks I never used them cause of the new extension at the time that obama signed in november. cause I had to go for my work search records check in january and the rep told me after the 13 week(9)which is tier 3 at the time I used 4 and I had 5 left so that is 9 tier 3. cause tier 4 would be 6 weeks . so something isn't adding up.he told me that I would automatically then go into eb 14 weeks. the 9 weeks took me exactly into feb 6th. new year and so I suppose to have lost that cause of a new year. I'm afraid to go down there but I guess I have to.

I don't believe you would be able to get additional monies from a previous benefit year. I'd highly doubt that anything was miscalculated. The only thing that might have happened is that perhaps wages for a certain quarter weren't reported by your employer, and if they happened to be the high quarter wages, then a lower quarter would have been used to calculate your weekly benefit amount. But the system has that formula and computation down cold...it always uses the high quarter in the base period to determine weekly benefit amount.
Thank you JDLJR. i calculate way higher amount when i take my high quarter or any quarter (since i used to get paid the same every quarter). but i guess i should have just gotten the max which is 505. instead i got around 450. when i went from one benefit year to another and get Tiers of EUC, the amount stayed the same. Should have it increased to a max, with the max increase around the state? thanks again

If your 2nd benefit year will end in April, you'll have to file for a new benefit year at that time. As with your previous benefit year, if you don't qualify for regular UI, they'll pull forward your unused extension money. That part would be automatic when you file your new benefit year.

If you never received EB but qualified for it, you should still be eligible for it. If you don't currently have a benefit year open, you need to open another one and see if something would pull forward.

If you have used your EB (some people don't realize that they did use EB before Tier 3, since they had to wait for the Tier 3 programming to be complete), then you might be waiting for the Tier 4 programming to be complete.

If it were me, I'd go back down there and sit with a supervisor, then, and have them explain it to me at a speed that I understood. I know most offices are very busy and they really don't (and sometimes can't) spend the amount of time with people that they need, but hopefully you'll find someone that can.

I think you filed your claim in Feb 2009, which means your base period would have been 4Q2007, 1Q2008, 2Q2008 and 3Q2008. Whatever your high quarter of wages (and again, maybe your employer didn't report your wages correctly, you could ask ESC) during those four quarters, divide by 26. Our system notes the high quarter (as reported by the employer) and divides by 26. I have never known it to make a mistake in that regard. Your amount may have stayed the same if your employer reported the same wages for each quarter. The ratio does not increase each year, just the maximum benefit amount. So if someone had $12,000 in their high quarter in 2008, their weekly benefit amount would be $461 (and the maximum benefit amount in 2008 was $494). If in 2009 when that person filed their 2nd benefit year, they had $12,000 yet again in their high quarter, their weekly benefit amount would still be $461, even though the maximum weekly benefit amount increased to $505 in 2009.

No no no.... I Mispoke!

My 2nd benefit year doesnt end in april
i meant my UI ends in April

I started a second benefit year in Jan 2010, and qualified for only 13 weeks, which run out at the end of April

THATS WHAT I MEANT sorry i was not clear

would they still automatically pull me into tier 3 at that time when my UI runs out for year 2 (the 13 weeks) since i dont qualify for any extensions on this year??

sorry, i know its confusing, even to me!

JDLJR in your example, if someone let's say had 25k in their high quarter, their weekly amount would be $494. i got that part. But when that person filed their 2nd benefit year in 2009, would it stay at 494 as original, or would go up to 505. thanks again

It is open cause they I told them to refile my claim. I kept filing after feb. 6th my year ended. processed for payment but I have never received anything exhaustion of benefits, filed the 20th 27th processed for payment but no money.the 27th went to claim on a "new benefit" year was the message. isn't that pull forward for tier 1V. so I'm assuming it was open. but I couldn't on 3/6 cause of exhaustion still. when I talked to the reps they had to send it to raleigh and then raleigh would tell them to reopen then I got this letter I wasn'teligible insufficient. funds. so I guess they didn't reopen. I have no issues just exhaustion of benefits.

I'm going to go ahead and repost this question since I didn't catch any responses on it and jdljr is back reading this thread. My original post was as follows:

Yesterday I went in person to the office in Raleigh, and after a hefty wait, sat down with a claims representative who viewed my claim and told me that everything is in order but my payments are frozen due to this programming error they're all talking about. She set me up with an appointment to see a claims specialist monday afternoon. This person is supposed to "Release my payments" to me. That's a little too long for me to wait to get paid, so I got on the phone this morning and got in touch with a claims specialist who went through, determined I'm eligible for extended benefits, and put in a request to "pull forward" my tier 1 benefits. He said that should go through by the end of this week.

Do you think the request he did is going to release my money to me, or do you think I'm going to have to come in person monday afternoon?
