missing rights is on a distinguished road
Default What happens if..

My parents got divorced in the 80's in Minot. My dad had a bunch of land up north around maxbass, he was at one time a farmer. The land and mineral rights had been passed down thru the family. In the divorce decree it specifically says to divide it up 4 ways. Mom, dad, brother and myself. Mine and my brothers were ordered in the divorce to be put in an irrovocable trust til we were adults. It never dawned on us to check about it, we were kids. Oblivious to whats going on in the court papers.
Come to find out now, he has sold everything, surface and mineral.
He never recorded it or put it in a trust like the court papers said he should have.
There is nothing on record in that county for our names. nothing its all gone.

Is there anything that can be done about that, since he went against a court order. It wasn't his to sell in the first place.

Any feedback on this would be greatly appreciated.

My suggestion would be to contact a lawyer to find out what laws apply to your particular situation, and what, if anything, you can do.

Good luck!

Definitely talk with a lawyer. You may not be able to get any of the rights but you may get your cut of whatever money he gained from the sale.
